boot catch failed! won't stay shut!

My boot wont close and it seems like there's no resitance in the boot catch, I have done a search but the only thing I've found is to do with a selinoid (spell check fail!). I can say the boot has being a bit tempermental with closing and sometimes took a further closure to stay secure (b.t.w my boot lock has never had an issue which other threads seem to relate to)

has anyone had a similar issue and fixed it (I guess it's just a spring thats failed?). I don't fancy going back to vw as they still havent supplied me with the right dip stick guide!! (another story and we will see tommorrow if it's finally right!)
